Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and P2 Reserve LLC ("Bearing Life," "we," "us," or "our") governing your access to and use of the Bearing Life mobile and web applications, our websites, and related services (together, the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. Bearing Life is intended for adults to organize and coordinate care for themselves and the people they care for.

You are responsible for the information you provide when registering and for all activity that occurs under your account. You may list yourself, or someone else, as the emergency contact for a person in your circle, with a phone number; that number is saved with that person's record, every member of that care circle can see it, and you can edit or remove it in the app at any time. You are responsible for keeping any phone number you provide accurate and up to date, particularly because the people in your circle may rely on it in an emergency. Bearing Life does not use passwords: you sign in with a one-time code sent to your email address, with a one-time code sent by text message (SMS) to your phone number if you choose the optional phone sign-in, or through a third-party provider (Google or Apple), and your use of those sign-in methods is also subject to those providers' terms. You are responsible for keeping your email account and any phone you sign in with secure and for never sharing a sign-in code with anyone. Notify us promptly at info@trybearinglife.com if you believe your account has been compromised.

2. The Service and Care Circles

Bearing Life lets you store and organize documents, health information, contacts, tasks, and reminders, and to invite other people into a care "circle" with permissions you control. You are solely responsible for whom you invite, the permissions you grant, and the information you choose to share with them. People you invite may be able to view, and depending on their permissions edit, information in your circle. Remove members or change permissions at any time in the app.

3. Information About Other People

You may enter information about other people, including care recipients and minor children. You represent and warrant that you are legally authorized to provide that information and to have us process it on your behalf, for example, as a parent, legal guardian, or with the person's consent. You are responsible for honoring any rights those individuals have in their information, and for responding to their requests, except where we are independently required to act.

4. Medical Disclaimer: Not Medical Advice

Bearing Life is an organizational and preparedness tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. Features such as the Bearing Score, medication tracking, drug-interaction warnings, immunization records, and AI-generated crisis plans are for general informational and organizational purposes only. They are not a substitute for professional medical judgment. Always consult a qualified healthcare provider, and never disregard or delay seeking professional advice because of something in the Service. We do not guarantee that any information in the Service (including drug-interaction data) is accurate, complete, or current.

5. Emergencies and Crisis SOS: Not an Emergency Service

Bearing Life is not an emergency response service and must not be relied on as one. In an emergency, call 911 (or your local emergency number) immediately. The Crisis SOS and crisis-plan features are aids to help you organize and act in a stressful situation. Delivery of alerts and location depends on your device, permissions, connectivity, and third-party networks, and may be delayed, incomplete, or fail entirely. Do not depend on the Service to summon help or transmit your location in a life-threatening situation.

6. Artificial Intelligence Features

The AI Scan and AI crisis-plan features use a third-party AI provider to read documents you scan and to generate readiness plans. AI output can be inaccurate or incomplete. For example, it may misread a document or omit a date. You are responsible for reviewing and confirming any AI-generated or AI-extracted information before relying on it. These features are optional, and you can always enter information manually. Our use of AI is described further in the Privacy Policy.

7. Subscriptions, Billing, and Refunds

Bearing Life is offered through a paid "Bearing Plus" subscription at $12.99 per month or $99.99 per year (plus any applicable taxes). On the yearly plan, new subscribers may start with a 14-day free trial that automatically converts to a paid yearly subscription unless you cancel at least 24 hours before it ends. The monthly plan has no free trial. What's included without a subscription is shown in the app before you pay. Our Billing & Refund Policy sets out the full details, including how to cancel before the trial converts, and is incorporated into these Terms.

Auto-renewal. Bearing Plus is an auto-renewing in-app subscription, sold through the app store you downloaded from (the Apple App Store or Google Play). Payment is charged to your store account (your Apple ID or your Google account), and the subscription automatically renews each month or each year, matching the plan you chose, at the then-current price unless you cancel at least 24 hours before the end of the current period. Your purchase is also subject to that store's applicable terms.

Cancellation. You may cancel at any time through your store's subscription settings (your Apple ID subscription settings, or Google Play subscriptions). Cancellation takes effect at the end of your current paid billing period. You keep Bearing Plus until then, after which it ends. Depending on your account, access is locked or returns to what is available without a subscription, as shown in the app. Your data is kept, not deleted, and you can resubscribe, restore a purchase, or delete your account at any time. If you cancel at least 24 hours before the yearly plan's free trial ends, you are not charged. We do not provide prorated refunds for the unused portion of a billing period. Deleting the app does not cancel a subscription.

Refunds. Refunds are handled by the app store you purchased through, under that store's policies. For an App Store purchase, Apple alone decides refunds, at its discretion, and we cannot grant or process them; request one at reportaproblem.apple.com. For a Google Play purchase, Google Play's policies apply, and Google may route your request to us; where it does, we consider it under our Billing & Refund Policy. For a Google Play purchase, request a refund through your Google Play order history, or email us at the address below. This does not limit any refund rights you have that cannot be waived under applicable law.

Changes. We may change our plans, features, and pricing prospectively; any price change applies to future billing periods and will be disclosed before it takes effect. Nothing in these Terms obligates us to offer any paid feature. If we later offer direct (non-app-store) billing, additional terms will be presented to you before you are charged.

8. Acceptable Use

You agree not to: (a) use the Service unlawfully or to store or transmit unlawful content; (b) upload information you are not authorized to share; (c) attempt to access another user's account or data without authorization; (d) interfere with, disrupt, reverse engineer, or probe the Service or its security; (e) use the Service to harass, harm, or impersonate others; or (f) use automated means to access the Service except as we expressly permit. We may suspend or terminate accounts that violate these Terms.

9. Your Content

You retain ownership of the information, documents, and other content you submit ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, store, process, transmit, and display Your Content solely to operate and provide the Service to you and the people you authorize (including syncing across devices, generating reminders and scores, and processing AI features). We do not sell Your Content and do not use it for advertising. This license ends when you delete the content or your account, except for residual copies in routine backups for a limited period and as required by law.

10. Our Intellectual Property

The Service, including its software, design, branding, and the "Bearing Life" and "Bearing" names and logos, is owned by P2 Reserve LLC and protected by intellectual property laws. We grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for your personal, non-commercial care-coordination purposes, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service except as permitted by law.

11. Third-Party Services

The Service relies on third-party providers (for example, our cloud backend, AI provider, email delivery, and mapping providers, as described in the Privacy Policy). We are not responsible for the acts, omissions, content, or availability of third-party services, and your use of any linked third-party service is at your own risk and subject to its terms.

12. Privacy

Our Privacy Policy explains what information we collect and how we handle it, and is incorporated into these Terms. By using the Service you acknowledge that information will be processed as described there, including transfer to and processing in the United States.

13. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any information, reminder, alert, or AI output will be accurate, timely, or delivered. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by law, P2 Reserve LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or for any personal injury or death, arising out of or relating to your use of, or inability to use, the Service, including any reliance on health information, reminders, drug-interaction warnings, crisis plans, AI output, or the Crisis SOS feature, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless P2 Reserve LLC and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, your violation of any law, or your submission of information about another person without authorization.

16. Termination

You may stop using the Service and delete your account at any time in the app, under Settings → Account → Delete account. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends; the sections that by their nature should survive (including Sections 3, 4, 5, 9–15, and 17) will survive.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to applicable law, any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in the State of Texas, and you consent to the personal jurisdiction and venue of those courts. Nothing in this section prevents either party from seeking injunctive or equitable relief to protect its intellectual property or confidential information.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email. The "Last modified" date shows when these Terms were last revised. Your continued use of the Service after a change takes effect means you accept the updated Terms.
